Terms of use

These terms govern the use of Teven. By connecting your Google account and using the service, you accept them. Read them carefully: the most important part is your responsibility for the recipients.

Who provides Teven

Teven is provided by Miquel Gomis, tax ID 52768567N, Calle Embajadores, 29, 2.º F, 28012 Madrid, España. Contact: support@teven.es.

Teven is designed and built by Miquel Gomis (www.miquelgomis.es).

The service

Teven uses AI to write a different email for each contact in a file you upload, based on an example email you write, and sends them from your Gmail account once you approve them. To use it you need a Google account and must be of legal age.

Your responsibility for the recipients

You are the sender of every email: it goes out from your account, in your name, after you review and approve it. You alone are responsible for who you write to, for having a legitimate basis to do so and for what the emails say. Reviewing before sending is there to make the result good; it doesn't shift that responsibility to Teven.

When sending commercial communications you must comply with the General Data Protection Regulation (GDPR) and, in Spain, the Information Society Services Act (LSSI-CE), as well as the equivalent rules in your recipients' countries. In Spain, the LSSI-CE forbids sending commercial communications by email to anyone who hasn't requested or authorised them beforehand, unless they're already your customer and you're offering products or services similar to those they bought. Before using Teven to write to people who don't know you, check that your case is allowed.

Before each send you declare that you have a legitimate basis to write to those addresses. That statement is recorded with the send.

You may not use Teven:

  • with bought, rented or scraped lists without a legitimate basis;
  • to send unsolicited email, or misleading, fraudulent, illegal or offensive content, or to impersonate anyone;
  • to try to get around Google's limits or Teven's sending pace.

If your emails are commercial, the law requires you to offer in each one a simple, free way to ask you not to write again. Teven doesn't add it for you: write it in your example email, for instance as a line at the end, and Teven will keep it unchanged in every email. Replies arrive in your Gmail and Teven doesn't read them: you agree to honour them and not to write again to anyone who asks.

Processing data on your behalf

For the contacts in your file, you are the controller and Teven is the processor (Article 28 GDPR). Teven:

  • processes that data only to write and send your emails, following what you do in the app;
  • deletes it within the periods in the privacy policy and doesn't keep the content or recipients of what was sent;
  • applies appropriate security measures and requires confidentiality from anyone who processes it;
  • uses the sub-processors listed in the privacy policy (Anthropic, Supabase, Vercel and Google), which you accept, and will tell you before changing them;
  • helps you respond to data subjects' rights and tells you without delay about any security breach affecting them.

Credits and payments

Each email Teven writes for sending uses one credit. Your example email and the first ones you see before paying are free. Credits are bought in packs, with no subscription, and never expire. Prices are shown excluding VAT, which is added at checkout according to your country.

Payment is handled by Link, from Stripe, which sells the credits on Teven's behalf and sends you the receipt. Its terms also apply to the purchase.

If Teven doesn't manage to write an email, or Gmail rejects the address when sending it, its credit goes back to your balance automatically.

Refunds

Credits are made available to you as soon as you pay. So, when buying, you expressly accept that immediate delivery and waive your right of withdrawal, as EU consumer law allows for digital content and services.

We refund unused credits only if Teven fails: if we shut the service down or an error on our side prevents you from using them. Ask at support@teven.es. This doesn't limit any rights the law gives you as a consumer.

Service limits

To protect your account, Teven sends with pauses and a daily cap, and at most 2,500 recipients per send. We can't guarantee that every email reaches the inbox: that depends on Google and on the recipient's mail servers. Google may limit or suspend your account if it considers it misused; Teven isn't responsible for those decisions.

We try to keep Teven running at all times, but there may be interruptions for maintenance or failures. If a send is interrupted, it resumes where it left off.

Suspension

We may suspend or close access for anyone who breaches these terms, especially the part about recipients, and stop a send in progress. In that case, unused credits aren't refunded.

Liability

You are liable to third parties for the emails you send and the data you use, and you'll hold Teven harmless from claims arising from your use. Teven's liability is limited to what you've paid in the last twelve months, except for wilful misconduct or gross negligence and without prejudice to your rights as a consumer.

Changes and governing law

If we change these terms, we'll announce it on the website in advance; continuing to use Teven means accepting them. They're governed by Spanish law. The courts of Madrid have jurisdiction over any dispute, unless you're a consumer, in which case those of your home address do.
